Business Terms and Conditions Concerning Participants

ARTICLE I / Binding Application

1. A binding application sent to the host is binding for the participant of the educational event (hereinafter referred to as "participant"). The host has the right not to register a binding application without being obliged to justify its decision.

2. After the receipt of the binding application, the participant is registered on the day on which the host receives to its account payment for the ordered services and for the participation fee which is stated in the duly completed binding application (unless stated otherwise).

3. If the binding application is cancelled and the participation fee for the ordered services has already been paid, the payment made shall not be refunded (unless stated otherwise).
 

ARTICLE II / Registration Fees

If the cancellation fee is cancelled by the participant after registration of the binding application, the paid registration fee shall not be refunded (unless stated otherwise).
 

ARTICLE III / Organization of Educational Event

1. The participant is obliged to respect and comply with all security and organizational measures taken by the host for the smooth running of the educational event, including check at the entry to the educational event and to all accompanying events taking place during the congress, including social evenings. When invited by the host, the participant is obliged to present their card of the congress participant made by the host. The participant’s card is non-transferable; the participant may not pass it on to a third person.

2. The host reserves the right to publish an overview of participants from among exhibitors, other companies and participants from authorities, foundations and secondary schools and universities.

3. The host reserves the right to change the lecturer, date or place, or to cancel the educational event no later than on the day of which the educational event is to take place.
 

ARTICLE IV / Insurance

1. The host is not responsible to the participants for the loss, destruction or any damage to their belongings, bags or luggage, regardless of whether such destruction or other damage occurred before, during or after the educational event.

2. All participants insure themselves. The host declares that the registration fee does not include the insurance of the participant during the congress.
 

ARTICLE V / Final Provisions

1. In the event that the host, due to circumstances beyond its control ("force majeure"), is unable to start the educational event, it shall immediately inform the participants in the educational event. In such case, all obligations arising for the host from the binding application shall cease to exist. In this case, the participants in the educational event shall not be entitled to any compensation for damages.

2. The participant in the educational event may file a complaint regarding services provided by the host with the responsible employee without undue delay, no later than on the day on which the educational event ended. Otherwise, their right shall expire.

3. If the participant violates any of the provisions of these general terms and conditions, the host shall be entitled to exclude the participant from further participation in the educational event. In such case, the participant in the educational event shall not be entitled to any compensation for damages or to the refund of the registration fee already paid or the payment for ordered services already made (unless stated otherwise).

 

Business Terms and Conditions Concerning Sponsors, Partners, Exhibitors and Their Agencies

• 1) The business rules regulate the position, rights and obligations of the organizer and the customer.
 

• 2) The customer must deliver the order within the deadline set by the organizer. On the day of the order confirmation, the order establishes the binding legal relationship between the organizer and the customer according to the Commercial Code of the Czech Republic. Orders are processed in order of the date of delivery to the organizer.
 

• 3) By submitting the order, the customer expressly agrees to these binding Business Terms and Conditions.
 

• 4) Advertising means the publication of a logo or ad on the website www.mhconsulting.cz, or in the Programme of the Event, if published, in accordance with the order and supporting materials supplied by the customer.
 

• 5) The exhibition space means the space in m2 with accessories or the space for an advertising banner according to the order.
 

• 6) Company presentation means a satellite symposium or sponsored lecture included in the professional programme of the event.
 

• 7) Allocated advertising, exhibition space or presentation may not be provided or otherwise assigned to a third party.
 

• 8) The organizer of the event is MH Consulting who is responsible to the hosts for the implementation of binding rules set by them.
 

• 9) All orders related to the participation in and presentation at the event must be confirmed with binding effect no later than 14 days before the event.
 

• 10) The organizer shall make the statement and invoicing of the orders confirmed with binding effect (hereinafter referred to as "binding order") in a manner ensuring that at least 75% of the total price of each binding order (including VAT) is paid within 14 days before the start of the event in the form of an advance (prepayment). Failure to pay the advance (prepayment) is the reason for unilateral cancellation of the binding order without compensation. This is an indispensable binding rule of the host.
 

• 11) The usual maturity period concerning invoices is 14 days in the Czech Republic. If the customer requires, in accordance with its own individual rules, a longer maturity period concerning the price invoiced for ordered services, it must adjust the deadline for the binding order according to paragraph 3 of these binding rules. 
 

• 12) The organizer shall make the statement of the final price of the binding order and invoice it immediately after the end of the event.

• 13) In the event of delay with payment of the final price, the organizer is obliged to charge the debtor with a late payment charge in the amount of 0.05% from the outstanding amount for each day of delay.
 

• 14) Delay with payment of the final price longer than 60 days is a reason for unilateral cancellation of orders for the debtor’s participation in other professional events of the host.
 

• 15) All payments to be made in accordance with these binding rules of the host must be made by bank transfer.
 

• 16) In accordance with the AIFP Code of Ethics, legal and ethical rules and binding commercial and payment rules of the host, funds provided by the partner or sponsor of the event may be used exclusively for the organization and preparation of the professional programme of the congress and for its material provision.
 

• 17) It is impermissible, at the time of the event and in the place of the event, to invite registered participants in the event to other, parallelly or separately organized or held events or programmes. Violation of this rule represents a legitimate reason for refusing the participation of the company (host or organizer of such an event or programme) in other professional events of the host.
 

• 18) If the customer cancels the order or part thereof:
 

within 90 days(inclusive) before the start of the event, the cancellation fee shall amount to 50% from the price of ordered advertising, exhibition space or presentation;
 

• within 60 days(inclusive) before the start of the event, the cancellation fee shall amount to 75% from the price of ordered advertising, exhibition space or presentation;
 

• within 30 days(inclusive) before the start of the event or later, the cancellation fee shall amount to 100% from the price of ordered advertising, exhibition space or presentation.
 

• The organizer is entitled to reduce the already paid price for advertising, exhibition space or presentation by setting off the cancellation fee or to demand its payment within 14 days, as soon as it learns about the cancellation of the order from the customer.
 

• 19) The organizer is entitled to exclude from the event a customer who fails to pay the price for the ordered advertising, exhibition space or presentation by the set deadline.
 

• 20) The organizer shall notify the customer without delay if the event is cancelled or will not take place due to a force majeure. On the day of such notification, all obligations existing between the organizer and the customer on that day shall cease to exist without compensation. As of that date, the organizer shall be entitled to use, on the basis of proper statement, the relevant corresponding part of the payments already made to cover the costs already incurred.
 

• 21) The customer or the exhibiting company undertake to comply with all instructions of the event organizer and to proceed in accordance with legal standards, in particular with the Act on Regulation of Advertising, specific requirements made by AIFP or MedTech in the event that the customer is their member, and with other orders issued by SÚKL (State Institute for Drug Control). The organizers do not assume financial or material responsibility for these violations.
 

• 22) The customer is obliged to insure all presented exhibits at its own expense. The organizer is not responsible for their loss or damage.
 

• 23) All prices are set by agreement and are stated without VAT.
 

• 24) Disputes arising from legal relationships established by this order shall be resolved in accordance with the legal regulations of the Czech Republic.
 

Sponsorship of event participants

• 25) Sponsorship of participants is promised only at the moment of sending a binding order via email or online form on the website www.mhconsulting.cz. Until the specified date, presented on the page of the specific event, the promise of sponsorship can be cancelled free of charge upon request, but after the deadline the order shall be considered binding with a 100% cancellation fee. Services ordered with binding effect cannot be cancelled after the stated deadline and must be paid in full by the sponsor, regardless of whether the service will eventually be actually used or not, even if the event is cancelled or will not take place due to circumstances beyond the host’s control ("force majeure"). Promised sponsorship cannot be transferred to another participant in the event. 

• 26) The total amount for the sponsored participants must be paid by the customer no later than 14 days before the event.
